Spark Driver™ Notice at Collection

Independent contractors in California have the right to receive notice at collection of our privacy practices. Notice at collection includes: (1) a list of the categories of personal information collected, including sensitive personal information (“SPI”); (2) the purposes for which the personal information and SPI are collected and used; (3) whether such information is sold or shared; (4) the length of time or criteria used to determine the time the personal information is retained; (5) if applicable, links to Notice of Opt-Out of Sale and Sharing; and (6) a link to the businesses’ privacy statement.


What Personal Information Do We Collect?

We may collect or receive (and may have collected or received during the 12-month period prior to the Last Updated date of the Privacy Statement) the categories of personal information listed below. Not all categories will be collected or received for every individual. 

  • Basic Personal Identifiers, such as name, telephone number, physical address, email address, government-issued identifiers (e.g., national identification numbers, driver’s license and information contained within a driver’s license, Social Security Number and card, and other tax identifiers), and signatures.
  • Device Information, Device Identifiers, and Other Online Identifiers, such as account login information, MAC address, IP address, cookie IDs, mobile ad IDs, operating system version, phone carrier and manufacturer, phone line type, application installations, and push notification tokens.
  • Internet, Network Activity Information, and Other Device and App Usage Information, such as information about your interactions with our Website or the Spark Driver App, including the pages or other content you view while the Spark Driver App is open or while on our Website, the actions you take on our Website or within the Spark Driver App itself, and the dates and times you visited our Website or opened the Spark Driver App.
  • Communications, such as the content of emails, text messages, social media posts or messages, or other communications, call logs, and surveys, where Walmart is a party to the exchange, or where you use chat features Walmart provides.
  • Demographic Information, such as age, gender, language, and date of birth.
  • Financial Information, such as information about your bank routing and account numbers, tax information, and other earnings and payment information (e.g., digital wallet information). 
  • Claims Information, such as personal information collected when an accident, injury, or other claim relating to your provision of Services (as defined in the Spark Driver Terms of Use) is reported. Walmart may investigate and collect such additional information regarding the claim as determined in Walmart’s discretion.  
  • Biometric Information, such as face geometry. Biometric information is collected with your consent by technology providers and/or service providers processing the data on our behalf. See Who Do We Disclose to & Why? section in the Privacy Statement for more information.
  • Geolocation, such as data about the location of your device, which may be imprecise (e.g., inferred from your device’s IP address). If you provide your consent, this data may be precise.
  • Sensory Information, such as information from camera and microphone access (e.g., audio and video recordings, ambient light sensor information), photographs (e.g., profile photos), and device movement (such as device orientation and acceleration).
  • Background Information, such as background checks and criminal convictions.
  • Driver Information, such as profile photo, driving record, vehicle information, vehicle insurance information, and business license and permitting information.
  • Inferences, such as individual preferences and characteristics. For example, we may draw inferences from and related to your trip, shopping, and delivery trends. See How Do We Use Personal Information section in the Privacy Statement to learn more about how we use inferences.
  • Content and Files and Other Photographs and Videos: We may collect photos or files you upload in the Spark Driver App or send via any communication with us. If you choose to participate in surveys, focus groups, or other voluntary research, we may photograph or make video and audio recordings as part of those voluntary research efforts.


We use information above that may be considered Sensitive Personal Information under some state laws for each of the purposes described below and to make inferences about you, for example to improve the Spark Driver Program and App and detect and prevent fraud. Where required by law, Walmart only processes this Sensitive Personal Information with your consent. Sensitive Personal Information includes precise geolocation and biometric information and may include some sensory information, some government identifiers (such as SSN and driver’s license), financial account information, background information, and any communications where Walmart is not a part.

How Do We Use Personal Information?

We use the categories of personal information above to provide you with services within the Spark Driver Program and use of the Spark Driver App and to operate and improve our business. For example, we use it for:

  • Performing and marketing services, including maintaining, servicing, improving, and promoting the Spark Driver Program, including the Spark Driver App and your driver account; displaying Service Offers; translating communications into a preferred language; providing customer service and driver support; verifying driving information; processing payments and earnings; notifying you about Services demand and compensation; or providing similar services or communications; operating incentive and rewards programs; or communicating order and delivery status to customers.
  • Fulfilling requests and obligations related to our partnership, including displaying relevant information about you to Receiving Parties (as defined in the Spark Driver Terms of Use) receiving Services from you, updating driver applicants on the status of an independent contractor registration, or calculating auto insurance policies and analyzing usage patterns for safety and insurance purposes.
  • Conducting auditing and monitoring of the Spark Driver Program.
  • Protecting the security and integrity of our websites, mobile services, and our business. This may also include responding to trust and safety issues that may arise, such as auto incidents, injury claims, disputes regarding deliveries, and requests from government authorities.
  • Improve the Spark Driver App and Spark Driver Program. This may include efforts to improve the efficiency of operations and the features available or offered to you in relation to the Spark Driver Program.
  • Helping to detect and prevent fraud and enforce our terms.
  • Updating our operational and technical functionality.
  • Debugging to identify and repair errors.
  • Conducting business analysis, such as analytics, projections, identifying areas for operational improvement, including analyzing how the driver community uses the Spark Driver App.
  • Conducting research, development, and training opportunities.
  • Short-term, transient use, such as non-personalized advertising shown as part of your current interaction with us.
  • Fulfilling our legal functions or obligations, including establishing and defending legal claims.


In some cases, these functions are carried out by automated technology. For example, automated technologies may use information about past choices, location, customer ratings, and demand in your area to order the offers presented to you and improve the efficiency and operations of our business. 


Do We Sell/Share Personal Information

California law defines certain disclosures as “sales” or “sharing.” Sales include disclosures of personal information to third parties for a money or some other benefit. Sharing includes disclosures of personal information to third parties for the purpose of cross-context behavioral advertising—or targeted advertising based on a consumer’s activities across different websites and services. We do not engage in sales or sharing of personal information collected under this privacy statement.

How Long Do We Retain Your Personal Information? 

We will keep the personal information we collect about you for as long as necessary to carry out the purposes set forth in this Privacy Statement or any other notice provided at the time of data collection, but no longer than as required or permitted under applicable law or internal policy. We dispose of the information we collect in accordance with our retention policies and procedures. 


Biometric Retention Schedule: For Illinois residents, as applicable, we will permanently destroy your biometric identifiers and biometric information when the first of the following occurs: (i) the initial purpose for collecting or obtaining such biometric data has been satisfied; or (ii) within 3 years of your last interaction with us.
